Terms&conditions

§ 1

Definitions

Terms used in Regulations mean:

  1. Regulations – this document,
  2. Service Provider or Coach – Marzena Arkabus conducting business activity under company B’Essence Studio Marzena Arkabus, address:   Piaskowa 47 lok. 26, 31-341 Krakow, NIP 9492122480, REGON 522556414,
  3. Client – an individual purchasing a service from Service Provider,
  4. Website – Provider’s website available at at www.markabus.eu,
  5. Service – a paid service provided by Service Provider (in including Online Service),
  6. Online service – a service provided by Service Provider by means of communication at distance,
  7. Agreement – an agreement for provision of services provided for in Regulations, concluded in accordance with provisions of the Regulations.

§ 2

Services provided electronically free of charge

  1. Any natural person of legal age may use content posted on Website free of charge and available features, such as:
    • The ability to direct a question through the contact form,
    • possibility to book the Service,
    • newsletter.
  1. At the moment the Client starts using Website, he/she enters into a contract with the Service Provider for provision of services by electronic means in to the extent indicated above. This is equivalent to acceptance of the Terms and Conditions. The contract is valid until when Customer stops using Website.
  2. In to use Website it is necessary to have access to Internet and a browser such as Microsoft Edge, Google Chrome, Mozilla Firefox, Safari – in current version.
  3. Client not may use Website in a way that violates the law, morality, personal rights of third parties or legitimate interests of the Service Provider. It is forbidden to provide information of unlawful nature.
  4. Any irregularities in functioning of the Website may be reported by the Customer by e-mail to address: welcome@markabus.eu. Service provider will consider the complaint in as soon as possible, not later than in within 14 days
    from making the notification.
  5. The Service Provider, to the fullest extent permitted by law, shall not be responsible for disruptions, including interruptions, in functioning of the Website caused by Force Majeure, unauthorized actions of third parties or incompatibility of the Website with technical infrastructure of the User.

§ 3

Services provided by Service Provider

  1. The Service Provider provides the following Online Services at in particular:
  • initial consultation,
  • individual coaching session,
  • Balanced Life Coaching individual program (package of 3 sessions).
  • The Service Provider provides online Services for a fee. Information about the Services, in particular their types, prices and duration, is indicated on Website.
  • Information regarding the processing of the Client’s personal data by Service Provider is described in Information Clause, which is an Appendix to Regulations.
  • Before the first consultation / session, the Coach may ask the Client to complete and send the Client Card and Consent to processing of special categories of data. Giving consent is voluntary, but failure to give it will prevent the Service from being provided.
  • During the first consultation, the Coach, on the basis of the interview conducted, analyzes the needs of the client, and then proposes further actions. Subsequent sessions are held according to individual arrangements – at generally sessions are held regularly at fixed time, at weekly or bi-weekly intervals.
    At the first meeting, the Parties set the rules for contact between sessions.
  • Coaching is a process in which the Coach supports the Client in achieving the Client’s goals, inspires and accompanies in the choices made. Goals in coaching are always determined and defined by the client.
  • Coaching is a confidential relationship, in which both parties commit to attentive action and mutual respect.
  • Coach shall keep confidential all information obtained from Client in connection with the Services provided, in particular information about Client’s health. The coach will not disclose, use or communicate information obtained
    in the process in any way to third parties. Without Client’s consent, Coach will not disclose information about the fact of cooperation with Client.
  • The client has the right to inform third parties about coaching process, in any way.
  • Both Coach and Client participate in coaching process from their own will. The customer can terminate the relationship at any time during the process. It is recommended to discuss this decision with each other as part of a joint learning experience.
  • The coach regularly supervises his work to maintain the highest standards of work ethics. In this purpose, some sessions may be recorded, and their audio recording will be used to realize the process of supervision of the Coach. Before any recording of sessions, the Coach each time asks the Client for permission to record sessions. Consent may be expressed in any form, in particular in e-mail or orally.
  • After the completed process, the Coach may send the Client an evaluation questionnaire with a request to fill it out and send it back. Completion of the survey is voluntary. Surveys are conducted at to monitor the quality of the Services provided.
  • Coach may refuse to provide the Service (which is tantamount to termination of the Agreement in immediate manner) in case when:
    • supposes that Customer is a minor or insane and in his/her name not occurs legal guardian or other authorized person,
    • provision of the Service would violate applicable laws, rules of professional conduct or the rights of third parties,
    • supposes that provision of the service may endanger the health or life of the Customer, his family members or other persons close to him ,
    • The Client, despite the summons, does not pay the payments due from for the provision of Services.
    1. In case of finding a threat to the Client’s health or life, Coach notifies the appropriate services.

    § 4

    Reservation and conclusion of the Agreement

    1. Customer may book the Service by contacting the Service Provider:
  • If the booking of the Service is made by e-mail, SMS or telephone, the Parties shall agree on the scope, term and form of payment during the telephone conversation, e-mail exchange or during the initial consultation. After determining the necessary issues, the Service Provider sends the Client, at the indicated e-mail address, a summary with a request for confirmation and acceptance of the Terms and Conditions.
  • The contract is concluded at the moment of receipt by the Customer of the e-mail message referred to in paragraph. 2 above. The conclusion of the Agreement means the booking of a date for the Service and the creation of an obligation of payment on the part of the Customer.
  • Payment must be made within 3 days from the date of confirmation of the booking, unless the Parties agree on another date. The reservation may be canceled if payment is not made by the agreed date.
  • Payments can be made:
    • by traditional transfer,
    • BLIK.
    1. A customer who has paid for the Service may request an invoice to be issued and sent. The customer agrees to send invoices in electronic form to the e-mail address specified by him.
    2. The contract on behalf of customers who are under 18 years of age and / or do not have full legal capacity is entered into by a parent, legal guardian or other person designated for care. It is sufficient for one parent/legal guardian to conclude the Agreement, and this is tantamount to a declaration by him that the other parent/other legal guardian does not object in this regard.
    3. The Client may cancel the Service by sending the Service Provider a text message to +48 603 078 358 no later than 24 hours before the agreed date. In this case, the customer may receive a refund of the payment made.
    4. If the Service is not canceled in accordance with paragraph. 8 above, and at the set time and within the next 15 minutes the Customer does not make an online connection, the Service will be considered completed. In this case, the Client shall cover the costs incurred by the Service Provider in preparing for the provision of the Service, as well as the costs incurred in connection with the failure to arrange a consultation / session of another Client, and therefore:
    • if the Customer has paid for the Service, he may request a refund of the fee paid, whereby the amount refunded will be reduced by the aforementioned. costs (50% of the amount paid),
    • if the customer was to pay during / after the appointment, he is required to make payment of 50% of the agreed amount.
  • Under special circumstances, with the prior consent of the Service Provider, the Parties may change the agreed term of the Service. For this purpose, the Service Provider should be contacted by e-mail, SMS or telephone, no later than 24 hours before the scheduled consultation / session.
  • In case of inability to provide the Service for a reason attributable solely to the Service Provider, the Service Provider shall offer the Client another date or a refund for the unused Service. If the Service Provider does not give at least 24 hours’ notice of cancellation, the Client is entitled to a 50% discount on the next visit.
  • In the event that the duration of the Service is shortened for reasons beyond the Service Provider’s control, the Client shall not have any claims against the Service Provider, in particular, he is not entitled to a refund of the payment made.
  • § 5

    Services provided online

    1. In order to use the Online Services, it is necessary for the Customer to have:
    • a computer, tablet or phone equipped with a webcam
      and microphone,
    • High-speed Internet connection – a minimum of 512kb/s (upload and download),
    • installed web browser,
    • active e-mail.
  • The initial consultation takes approx. 30 minutes.
  • A coaching session lasts approx. 60 minutes.
  • Services are provided through the ZOOM platform (contact using another communicator is possible upon request).
  • Before starting the consultation / session, the Client should click on the link sent in the email and wait for the Service Provider to establish a connection.
  • The Service Provider is not responsible for technical problems, network problems or technical limitations occurring on the equipment used by the Client, which prevent him from using the consultation / online session. If the consultation / session cannot take place or is significantly hindered for the reasons indicated above, the client is not entitled to a refund of the payment made for the consultation / session.
  • The Client has the right to record consultations / sessions only after obtaining permission from the Service Provider.
  • The service provider has the right to record consultations / sessions only after obtaining the consent of the Client.
  • § 6

    Complaints

    1. Announcements, advertisements, price lists and other information about the Services provided on the Website do not constitute an offer within the meaning of Art. 66 §1, but only an invitation to conclude a contract within the meaning of Art. 71 of the Act of April 23, 1964 – Civil Code (Journal of Laws of 2014, item 121 as amended).
    2. The customer has the right to file a complaint within 14 business days from the date the Service was provided. The complaint should be sent in writing or electronically to the Service Provider’s addresses indicated in the Regulations.
    3. The complaint should contain data that allows identification of the Customer (name, mailing address, e-mail address), the subject of the complaint (e.g. type and date of the defect) and the demands related to the complaint. In case of receipt of an incomplete complaint, the Service Provider will call for its completion, under pain of leaving the complaint unprocessed.
    4. Complaints are processed within 14 business days from the date of receipt of a complete complaint.

    § 7

    Withdrawal from the contract

    1. Klient, będący Konsumentem w rozumieniu Kodeksu Cywilnego, który zawarł Umowę na odległość, ma prawo odstąpić od Umowy bez podawania przyczyny w terminie 14 dni od dnia zawarcia Umowy.
    2. Prawo do odstąpienia od Umowy na zasadach opisanych w niniejszym paragrafie przysługuje również osobie fizycznej zawierającej Umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej Umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego.
    3. W przypadku, gdy Klient odstąpi od Umowy po rozpoczęciu świadczenia Usługi przez Usługodawcę, Klient ma obowiązek zapłaty za świadczenia spełnione do chwili odstąpienia od Umowy. Za wykonywanie Usługi uznaje się także analizę sytuacji i potrzeb Klienta, którą Usługodawca przeprowadza przed konsultacją / sesją.
    4. Aby odstąpić od Umowy, Klient musi poinformować Usługodawcę o swojej decyzji o odstąpieniu od Umowy w drodze jednoznacznego oświadczenia – na przykład pisma wysłanego pocztą lub pocztą elektroniczną. Klient może skorzystać ze wzoru Formularza odstąpienia od Umowy, który stanowi Załącznik do Regulaminu.
    5. W przypadku odstąpienia od Umowy, Usługodawca zwraca Klientowi wszystkie otrzymane od Klienta płatności niezwłocznie, a w każdym przypadku nie później niż 14 dni od dnia, w którym Usługodawca został poinformowany o wykonaniu prawa odstąpienia od Umowy.

    § 8

    Final provisions

    1. As part of the Coach’s professional development and continuous improvement of competencies, the Coach applies for accreditation of his skills with the ICF (International Coach Federation) organization. For this purpose, the session hours will be recorded and counted in the declaration of the required working time. The client agrees to provide the number of hours and contact information (email address) for presentation to ICF.
    2. All materials made available in the course of or in connection with the provision of the Service, including articles, support materials provided to the Client, psychological advice recorded on any medium are works, the copyright of which is vested in the Service Provider and are protected by copyright under the terms described in the Law of February 4, 1994. On Copyright and Related Rights (Journal of Laws 1994 No. 24, item 83). Any use of the materials referred to above, in particular dissemination, copying, resale, public or individual sharing, is possible only with the prior written consent of the Service Provider.
    3. In matters not covered by these Regulations, the provisions of Polish law shall apply, including in particular the Civil Code.
    4. The Service Provider reserves the right to change the content of the Terms and Conditions. Customers are bound by the content of the Terms and Conditions from the date of booking the Service / conclusion of the Agreement.
    5. Settlement of any disputes arising between the Service Provider and the Client who is a Consumer, shall be submitted to the courts of competent jurisdiction in accordance with the provisions of the Code of Civil Procedure. Settlement of any disputes arising between the Service Provider and the Client who is not a Consumer shall be submitted to the court having jurisdiction over the seat of the Service Provider.
    6. The regulations come into effect on April 3, 2023.
    7. An integral part of the Terms and Conditions is the Personal Data Processing Information Clause and the Contract Withdrawal Form.
